1. These General Terms and Conditions govern the contractual relationship between customers, hereinafter referred to as \u201cthe Customer,\u201d and Br\u00fclhart Media GmbH in connection with the use, ordering, and management of the B-CARD digital business card.
2. By signing a contract, placing an electronic order, or confirming that they have read and accepted these Terms and Conditions, the customer accepts these Terms and Conditions.
3. For additional services, integrations, or products from third-party providers\u2014in particular Google, Facebook, Meta, hosting providers, map providers, or other external services\u2014the respective terms and conditions of these third-party providers shall apply in addition.
4. To the extent that specific matters are not expressly addressed in these B-CARD Terms and Conditions, the General Terms and Conditions of Br\u00fclhart Media GmbH shall apply in addition.<\/p>\n
1. The contract is concluded upon signing a contract, placing an electronic order, or receiving a comparable written or electronic confirmation.
2. By placing an order, the customer confirms that he is authorized to order the B-CARD and that he has provided truthful information necessary for its creation and publication.
3. Br\u00fclhart Media GmbH may reject orders without providing a reason. The customer will be notified of any rejection within 7 business days, if possible.
4. If services or features from third-party providers are integrated on behalf of the customer, the customer authorizes Br\u00fclhart Media GmbH to set up the necessary technical infrastructure, accounts, links, or integrations. <\/p>\n
1. The term of the contract begins upon its conclusion, unless otherwise agreed in the contract or in the order.
2. If a specific contract term is agreed upon, the contract shall remain in effect for that duration. Unless the contract is terminated in writing at least 2 months before the end of the contract term, effective at the end of the month, it shall be automatically extended for the agreed-upon term.
3. Early termination before the end of the agreed contract term does not entitle the customer to a reduction or waiver of the agreed fee.
4. For B-CARD subscriptions, no pro-rata refund will be issued if the customer terminates use before the end of the contract term or ceases to use the service. <\/p>\n
1. Br\u00fclhart Media GmbH provides the customer with the B-CARD, a digital business card that may include various features and display options depending on the selected package.
2. The specific scope of services is determined by the selected package, the quote, the order, or the currently valid service description on the website.
3. The B-CARD may include, in particular, personal contact information, company details, images, logos, links, locations, social media links, QR codes, download features, contact options, or other digital content.
4. Once the B-CARD has been completed or activated, the customer will receive the necessary links, login credentials, or other information electronically.
5. If a back office or administrative area is provided, the customer may manage the designated content on their own. Advanced customizations, technical modifications, design changes, package changes, custom features, or support services may be subject to a fee.
6. Br\u00fclhart Media GmbH is entitled to make technical, design, or functional adjustments to the B-CARD system, provided that such adjustments do not significantly impair the essential purpose of the contract. <\/p>\n
1. The customer is required to provide all content, details, images, logos, text, contact information, and other information necessary for the creation and operation of the B-CARD in a timely and accurate manner.
2. The customer is solely responsible for ensuring that the content provided is up-to-date, complete, lawful, and free of third-party rights.
3. The customer confirms that it holds all necessary rights to the delivered content and that its publication does not infringe upon any personal rights, copyrights, trademark rights, data protection rights, competition laws, or other rights of third parties.
4. The customer is required to review the published B-CARD regularly and to immediately report any incorrect, outdated, or unwanted content to Br\u00fclhart Media GmbH or, if possible, to correct it themselves.
5. The customer may not use the B-CARD for illegal, immoral, misleading, discriminatory, political, extremist, violence-glorifying, pornographic, fraudulent, or otherwise prohibited content.
6. Br\u00fclhart Media GmbH reserves the right to reject, modify, block, remove, or delete content for legal, moral, ethical, political, technical, or other objective reasons.<\/p>\n
1. The customer grants Br\u00fclhart Media GmbH the rights of use to the delivered content necessary for the performance of the contract. This includes, in particular, the storage, editing, technical processing, publication, and display of the content within the framework of the B-CARD.
2. The grant of rights shall remain in effect for the duration of the contractual relationship and, to the extent necessary, beyond that period\u2014for example, to comply with statutory retention requirements, for documentation purposes, or to settle outstanding claims.
3. The customer shall fully indemnify Br\u00fclhart Media GmbH against any claims by third parties asserted in connection with content supplied or approved by the customer. This includes, in particular, claims for damages, legal costs, and other expenses.
4. Br\u00fclhart Media GmbH is entitled to use publicly accessible B-CARDs, references, screenshots, logos, or general project information for its own advertising, reference, and presentation purposes, unless otherwise agreed in writing. <\/p>\n
1. The B-CARD is operated using a technical infrastructure selected by Br\u00fclhart Media GmbH. Br\u00fclhart Media GmbH may use its own systems or external hosting and infrastructure partners for this purpose.
2. Br\u00fclhart Media GmbH strives to ensure the reliable operation of the B-CARD, but cannot guarantee uninterrupted availability, error-free operation, or continuous accessibility at all times.
3. We expressly reserve the right to suspend service due to maintenance work, technical malfunctions, updates, security measures, server problems, network disruptions, force majeure, attacks by third parties, or events within the control of hosting providers or third-party providers.
4. Br\u00fclhart Media GmbH is not liable for outages, delays, data loss, or malfunctions attributable to events beyond its direct control.
5. Br\u00fclhart Media GmbH is entitled to perform technical maintenance, security updates, or system adjustments. In doing so, it will make every effort to minimize any disruption to the customer. <\/p>\n
1. Depending on its configuration, the B-CARD may include external services, links, or third-party content, such as map features, route planning, social media links, contact features, analytics tools, or other embedded content.
2. For third-party services, the third parties\u2019 own terms of use and privacy policies also apply. Br\u00fclhart Media GmbH has no influence over the ongoing operation, availability, presentation, or data processing by third parties.
3. If an external service is integrated at the customer\u2019s request, the customer is responsible for ensuring that the use of this service is permitted for the customer\u2019s intended purpose and that the necessary information, notices, or consents are available.
4. Tracking or analytics tools are used within the B-CARD only if this is technically provided for, requested by the customer, or contractually agreed upon. <\/p>\n
1. Br\u00fclhart Media GmbH processes personal data in accordance with the provisions of Swiss data protection legislation.
2. Within the framework of the B-CARD, the following data in particular may be processed: contact information, names, job titles, phone numbers, email addresses, images, links, location data, company information, and technical data.
3. The customer is responsible for ensuring that the personal data of employees, representatives, or third parties published on the B-CARD may be used lawfully.
4. In particular, the customer confirms that the individuals concerned have been informed of the publication of their data and, where necessary, have given their consent.
5. When third-party providers are integrated\u2014such as map features, external links, or analytics tools\u2014data may be transferred to these providers. Details regarding this are set forth in the B-CARD Privacy Policy or on the relevant website.
6. Br\u00fclhart Media GmbH may process data to the extent that such processing is necessary or permitted for the fulfillment of the contract, technical provision of services, security, billing, customer service, further development of services, or for its own advertising and reference purposes. <\/p>\n
1. Prices for the B-CARD are based on the selected package, the quote, the order, the contract, or the currently valid price list.
2. Invoices must be paid in full within the payment term specified on the invoice. Unless otherwise agreed, the payment term is 30 days from receipt of the invoice.
3. In the event of late payment, Br\u00fclhart Media GmbH is entitled to deactivate, block, or remove content, access, features, or the entire B-CARD without prior notice. The customer shall have no claim for damages arising therefrom.
4. Outstanding amounts remain due even if the B-CARD is deactivated, blocked, or removed.
5. Additional services, support, customizations, data recovery, data changes, package changes, or special technical requests may be billed separately. <\/p>\n
1. Upon expiration of the payment deadline specified on the invoice, the customer is automatically in default without the need for a further reminder.
2. Br\u00fclhart Media GmbH is entitled to charge the following reminder fees in the event of late payment:
1st reminder: CHF 15.\u2013
2nd reminder: CHF 30.\u2013
3. We reserve the right to assert further consequences of default as well as any additional damages.<\/p>\n
1. Except in cases of gross negligence, Br\u00fclhart Media GmbH is liable only for direct damages or damages caused intentionally.
2. Liability for agents of Br\u00fclhart Media GmbH is excluded to the extent permitted by law.
3. Liability is limited to a maximum of the refund of the fees paid by the customer for the relevant contract period.
4. Br\u00fclhart Media GmbH assumes no liability for lost profits, consequential damages, data loss, business interruptions, reputational damage, outages, maintenance work, technical malfunctions, or the services of third parties.
5. Br\u00fclhart Media GmbH assumes no liability for content, information, images, links, or other information provided, approved, or managed by the customer.<\/p>\n
1. Any amendments or additions to individual contracts must be made in writing or confirmed electronically in a verifiable manner.
2. Br\u00fclhart Media GmbH reserves the right to amend these Terms and Conditions at any time. The customer will be notified of any material changes.

2. Valid reasons include, in particular, late payment, illegal content, misuse, infringement of third-party rights, security risks, or actions that could impair the operation, security, or reputation of Br\u00fclhart Media GmbH or B-CARD.
3. Amounts already owed remain due even in the event of suspension, deactivation, or termination for cause.<\/p>\n
1. For customers with a residence or place of business outside Switzerland, the registered office of Br\u00fclhart Media GmbH shall be the place of enforcement and the exclusive venue for all proceedings.
2. The venue shall be the registered office of Br\u00fclhart Media GmbH, unless otherwise required by mandatory statutory provisions.<\/p>\n
